Terms of Service

1. Acceptance of terms

By creating an account or using TagTalk, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the service.

2. Who can use TagTalk

You must be at least 13 years old (or the minimum age in your region) and able to form a binding contract. If you use TagTalk on behalf of an organization, you represent that you are authorized to do so.

3. Your account

You are responsible for the accuracy of your account details and for keeping your login secure. You are responsible for activity that happens under your account. Notify us promptly of any unauthorized use.

4. Membership, trials & billing

• AI conversation practice is offered free of charge. Premium features require a paid membership.
• New members may receive a 30-day free trial. Unless you cancel before it ends, the membership converts to a paid subscription at the then-current price (currently $9.99/month).
• Subscriptions renew automatically until cancelled. You can cancel anytime and retain access through the end of the current billing period.
• Payments are processed by Stripe. You authorize us and Stripe to charge your payment method for applicable fees.

5. Teacher packages & payments

• Instructors set their own packages, deliverables, prices and billing cycles. Subscribing to a package is a separate transaction from your TagTalk membership.
• Instructors keep 100% of the amounts students pay for their packages. TagTalk does not take a commission on package payments.
• Payouts to instructors are made via Stripe Connect, subject to a minimum withdrawal amount and release once the relevant service period completes.
• Instructors are responsible for delivering the services described in their packages and for their own taxes.

6. Refunds

Membership fees may be refundable at our discretion or as required by law. Package-related disputes are handled case by case; refunds processed for a package may be deducted from the relevant instructor's earnings. Contact us if you believe you're entitled to a refund.

7. Acceptable use

You agree not to misuse TagTalk, including by: violating any law; harassing or abusing others; uploading harmful, infringing or unlawful content; attempting to disrupt or reverse-engineer the service; or using it to send spam. We may suspend or terminate accounts that violate these terms.

8. Your content

You retain ownership of the content you create (chats, journals, recordings, messages). You grant TagTalk a limited license to host, process and display your content as needed to operate the service, including processing by AI providers to generate feedback. You are responsible for the content you share.

9. AI and educational disclaimer

TagTalk uses AI to assist learning. AI-generated corrections, lessons and translations may be inaccurate and are provided for educational purposes only. TagTalk does not guarantee any particular learning outcome or fluency result.

10. Intellectual property

The TagTalk name, logo, software and design system are owned by TagTalk and protected by law. These terms do not grant you any right to use our branding without permission.

11. Disclaimers & limitation of liability

TagTalk is provided “as is” without warranties of any kind. To the maximum extent permitted by law, TagTalk is not liable for indirect, incidental or consequential damages, and our total liability is limited to the amount you paid us in the 12 months before the claim.

12. Termination

You may stop using TagTalk and close your account at any time. We may suspend or terminate access if you breach these terms or where necessary to protect the service or other users.

13. Changes to these terms

We may update these terms from time to time. If we make material changes, we will provide reasonable notice. Continued use after changes take effect means you accept the updated terms.
